Means-Plus-Function クレームとnonce word

暇なので、今まで曖昧にやり過ごしてきたことを整理している。備忘録としてここに書いおく。

今日は、nonce word.  「臨時語」というらしいが、これでは意味が分からない。

mechanism, module, device, unit, component, element, member, apparatus, machine, systemなど具体的な構造がわからない包括語で、最近の特許明細書で means for ～ の代わりに使われている語のことだ。

日本の特許出願明細書では、具体的な構造を記載しないで機能だけで限定したクレームを多く見かける。日本から米国に出願する際、Means や Step という単語を使わなければ米国特許法 第112 条(f)が定める Means-Plus-Function クレームには当たらないとされてい来たがので、特に、means の代わりにdevice や unit などの代用語を使うことにしていたし、そう指示されることが多かった。

しかし、2015 年の Williamson 判決以降，Means や Step を使用しない場合でも機能的に表現されている構成要件についてはMeans-Plus-Function クレームとして審査されることとなった。

改定された米国審査基準（Manual of Patent Examining Procedure: MPEP) 2181 には以下のように記載されている。

… examiners will apply 35 U.S.C. 112(f) or pre-AIA 35 U.S.C. 112, sixth paragraph to a claim limitation if it meets the following 3-prong analysis:

(A) the claim limitation uses the term “means” or “step” or a term used as a substitute for “means” that is a generic placeholder (also called a nonce term or a non-structural term having no specific structural meaning) for performing the claimed function;
(B) the term “means” or “step” or the generic placeholder is modified by functional language, typically, but not always linked by the transition word “for” (e.g., “means for”) or another linking word or phrase, such as “configured to” or “so that”; and
(C) the term “means” or “step” or the generic placeholder is not modified by sufficient structure, material, or acts for performing the claimed function.

審査官は、クレームの限定が以下の３つに合致する場合、米国特許法第 １１２条（f）または旧米国特許法法第 １１２条第６段落を適用する。

(A) 請求項を限定するために、請求項の機能を実行する包括的代用語（特定の構造的意味を持たない非構造的な用語であり、nonce termとも呼ばれる）である”means”、”step” 、あるいはその代替として使用される語を使用している場合

B）必ずしも移行語や連結語と連結しているとは限らないが、例えば”means for" など ”for”に代表される移行語や、”configured to”、”so that”などの連結語（句）と連結する機能表現などのが、means”または”step”、あるいは包括的な代用語を限定する場合。

C）”means” または ”step”、あるいは包括的代用語が、クレームされた機能を実行するための十分な構造、材料、または行為によって限定されていない場合。

というわけで、、”configured to" なんて安易に使わないで、ようく考えて、気を付けて使わなければいけないのであった。しかし、翻訳者が勝手に作文するわけにもいかないからね～。
